Al Balagh Quran Academy (“Academy”, “we”, “us”, or “our”) provides online and offline Quran education courses. By accessing or using our services (website, mobile app, classes), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use our services. These Terms apply to all students, parents, and users.
- Acceptance of Terms
By registering for or attending any course, you confirm that you have read, understood, and agreed to these Terms. This includes all sections and policies referenced here. These Terms form a binding agreement. We may update them at any time (see Section 12 below). Your continued use of our services after changes signifies acceptance. Always review the “Last Updated” date above and any notifications we provide.
- Eligibility and Age Restrictions
Our courses are designed for students aged 4 and above, but students under 18 must have a parent or legal guardian’s consent. Minors: If you are a minor (under the age of majority in your jurisdiction), your parent or guardian must agree to these Terms and supervise your use of the service. We do not knowingly collect personal information from children without appropriate consent. In particular:
- United States: The Children’s Online Privacy Protection Act (COPPA) applies to children under 13. We require verifiable parental consent for users under 13. No one under 13 may create an account or access our online services without permission.
- European Union: The EU’s General Data Protection Regulation (GDPR) sets the default digital consent age at 16 (Member States may allow as low as 13). Users under this age must have a parent or guardian’s consent.
- India: Under India’s Digital Personal Data Protection Act (DPDP Act, 2023), a “child” is defined as under 18, and processing a child’s data requires parental consent.
In practice, any student below 18 (4–17 years old) must register through a parent/guardian, who agrees to and is responsible for these Terms. Users aged 18 or over may register and use services on their own.
- Account Registration and Security
To access our courses, you must register for an account with accurate, up-to-date information.
- You must provide your real name, a valid email, and any other required details. Accounts for minors should list the parent/guardian’s information.
- You are responsible for your login credentials. Do not share your password or account with others. Keep your password secure and confidential.
- You agree to notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate accounts for fraudulent or improper activity.
- You may only have one account per person. Creating multiple accounts is prohibited.
Failure to maintain accurate information may lead to termination of the account. You are responsible for all activity under your account.
- Course Enrollment and Usage Rules
4.1 Online Course Usage
Online courses include video lessons, live classes, digital quizzes, and downloadable materials. When using our online courses, you agree to:
- Use the content solely for your personal educational purposes. You may view, download, or print materials for learning only. You may not copy, distribute, modify, or share any course materials, videos, handouts, or recordings without our written permission.
- Not record, screenshot, or redistribute live class sessions or educational content. Unauthorized sharing of login credentials or proprietary materials violates our policies.
- Complete assignments and quizzes honestly. Academic dishonesty (cheating, plagiarism) is prohibited. We reserve the right to review submitted work for integrity.
- Behave respectfully in any live sessions or forums. Hate speech, harassment, bullying, or disruptive behavior will lead to account suspension.
We may monitor usage and communications on our platform to enforce these rules. If we determine you have misused content or disrupted classes, we may restrict or revoke access without refund.
4.2 Offline Course Usage
Offline (in-person) courses take place at our physical location(s). Rules include:
- Students and guardians must obey the facility’s code of conduct (e.g. arrive on time, dress appropriately, follow instructor directions). We may have specific rules (e.g. no eating in class, mobile phones silent).
- ID Verification: In India, students attending offline courses will be asked to provide government-issued ID or school ID for verification and safety. We collect and retain this data securely as required by local regulations.
- Guardians of young children are expected to supervise them before/after class times. The Academy is not responsible for students outside scheduled class hours or activities.
- Recording or photographing instructors or other students without permission is strictly prohibited.
- We do not guarantee any particular level of success or student outcome. Any progress depends on the student’s participation and diligence.
We reserve the right to dismiss any student from a class or the program for serious misconduct or violation of rules. No refunds will be given for students dismissed for cause.
- User-Generated Content
Students or users may submit content such as assignment answers, recorded practice recitations, forum posts, feedback, or reviews (“User Content”). By submitting User Content:
- Ownership: You retain all intellectual property rights in your User Content. However, you grant the Academy a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and prepare derivative works of that content in connection with the courses. This license allows us to provide course feedback, publish examples (with or without attribution), and improve our offerings.
- Content Standards: You affirm that you own or have permission to use any materials you post. Do not upload content that is illegal, defamatory, obscene, harassing, or that infringes any third-party’s intellectual property or privacy rights. Examples of prohibited content include copyrighted text or images not in the public domain, hate speech, pornography, or malware.
- Moderation: We reserve the right (but are not obligated) to review, edit, refuse, or remove any User Content at our discretion. If we remove content or terminate access due to violations, you will not receive a refund.
- Indemnity: You agree to indemnify and hold the Academy harmless from any claims arising from your User Content.
Failure to comply with these rules may result in termination of your account. We are not liable for User Content posted by others on our forums or platforms.
- Data Collection and Privacy
We collect personal data to provide and improve our educational services. This includes information you or your guardian provide (name, email, age, address, school information), payment details (card details processed by gateways), and data from course usage (e.g. quiz results, attendance). Specifically:
- Offline Enrollment ID: For in-person classes (particularly in India), we require government-issued ID or school ID of the student to verify identity and age. This is used solely for compliance and safety.
- Online Accounts: We collect email addresses, contact numbers, and optionally demographic info to manage accounts and communications.
- Sensitive Data: In India, educational records of a child are classified as personal data. We handle all student data, especially children’s data, with extra care. We obtain parental consent before collecting any personal data for users under the age thresholds mentioned above.
- Usage Data: We use cookies and analytics to enhance user experience, track progress, and improve our platform.
All data is processed in compliance with applicable laws:
- GDPR (EU): For EU users, we adhere to the GDPR. Parents must consent for children under the GDPR age of consent (normally 16, see Section 2). EU users have rights (access, correction, deletion) over their data.
- COPPA (US): For U.S. users under 13, we obtain verifiable parental consent and only use data for educational purposes, with parent control.
- India’s DPDP Act: For Indian users, we comply with the DPDP Act, which defines a child under 18. We process data based on consent or legitimate interest for providing courses.
We do not sell or rent personal information. We may share data with trusted third parties only as needed (payment gateways, analytics providers, online class platforms, or for legal compliance). All third parties are obligated to protect your data. (For details, see our Privacy Policy.)
Payment Data: Payments are processed via secure third-party gateways (e.g. Razorpay). We do not store full credit/debit card numbers or payment credentials. Payment data is handled in accordance with PCI-DSS standards by those providers.
- Third-Party Services and Links
Our website or courses may include links or integrations with third-party services (e.g. Zoom, Google Classroom, YouTube, educational apps) and external websites. When you use such services or links:
- You are subject to the terms and privacy policies of those third parties. We encourage you to review them. The Academy is not responsible for their content, security, or actions.
- We do not endorse or assume any liability for goods or services offered by third parties. Any transactions or interactions on external sites are at your own risk.
- For payments, third-party gateways (Razorpay, etc.) may charge transaction fees. We do not impose additional surcharges beyond the actual processing cost. As required by regulatory guidelines, we clearly display our refund and cancellation policy on this site.
- We are not liable for losses or data breaches occurring on third-party platforms, though we encourage all users to use reputable, secure services.
- Payment Terms and Refund/Cancellation Policy
Payment: All course fees must be paid in full before enrollment. We accept online payments (credit/debit cards, UPI, netbanking, etc.) via our payment gateway partners. Payment is due upon registration; we will not provide access to paid services if payment fails. Prices are as listed on the website and include applicable taxes (e.g. GST). We reserve the right to change fees, but any increase will not affect courses already purchased.
Refunds and Cancellations: We strive to provide quality education, so please choose courses carefully. Our refund/cancellation terms are:
- Online Courses (Distance Learning): In accordance with consumer protection laws (e.g. EU Distance Selling Directive 2011/83/EU), you have the right to cancel without penalty within 14 days of purchase if the course has not yet begun. If the course has already started (or you have accessed materials or recorded lectures), the 14-day right typically expires once performance begins.
- In addition, we may offer a short “no-questions” refund window (e.g. 7 days from purchase) provided you have not accessed the content. Contact support to request a refund within this period. Refunds beyond this period are not guaranteed.
- Offline Courses (In-Person): Full refunds are available if you cancel at least 30 days before the course start date. Cancellations made 15–29 days before start incur a 50% penalty; less than 15 days – no refund. You may request a date transfer or credit instead, at our discretion.
- Cancellation by Academy: If we cancel a course (low enrollment, etc.), you will receive a full refund or be offered an alternative.
- Processing: Approved refunds will be processed back to the original payment method (credit/debit account, UPI ID, etc.). This typically occurs within 7–15 business days, depending on banks. We are not responsible for bank processing delays.
- Fees and Taxes: Payment gateway or banking fees are generally non-refundable, unless required by law.
No refunds or credits are given for partial attendance, missed classes, or voluntary withdrawal after course start, except as noted. Please read all course details carefully before enrolling. We display our full refund and cancellation terms on our site as required.
- Limitation of Liability and Disclaimers
To the fullest extent permitted by law, Al Balagh Quran Academy is not liable for any direct, indirect, incidental, consequential, special or punitive damages arising out of your use of our services. This includes (but is not limited to) injury, loss of data, loss of profits, or emotional distress.
- Content Use: Course content and materials are provided “as-is” for educational purposes. We do not warrant accuracy, completeness, or usefulness of any content. We disclaim all representations and warranties (express or implied), including fitness for a particular purpose, merchantability, and non-infringement.
- Health & Safety: Quranic studies are generally safe, but learning may involve practices (like memorization, recital). We are not responsible for any discomfort or strain (e.g. eye strain, stress) from course activities. For offline classes, students participate at their own risk. We do not guarantee against accidents; parents/guardians are responsible for their child’s safety during classes.
- Third-Party Services: Any advice or content provided by third-party instructors or platforms is not endorsed or guaranteed by us. You use all third-party services at your own risk. We disclaim liability for their performance or security.
- Technical Issues: We strive for uptime but do not guarantee uninterrupted service. Temporary outages, delays, or errors may occur. We are not liable for losses caused by such events or by viruses/malware from our site or links.
- Accuracy of Information: We try to keep course info and schedules up-to-date, but errors may occur. We reserve the right to correct mistakes in pricing, scheduling, or course descriptions. No liability for such errors.
Where local law restricts disclaimers (for example, consumer protection laws in certain jurisdictions), our liability will be limited to the maximum extent permitted by those laws. In many places, our total liability (if any) is capped at the fees paid for the specific course in question.
- Intellectual Property Rights
All content on this site and in our courses – including text, videos, audio, graphics, logos, and lesson materials – is the intellectual property of Al Balagh Quran Academy or its licensors. This includes any translations, commentary, or explanations we provide (even though the Quran itself is public domain, our presentation and related materials are protected).
- Use of Content: You may view and use course materials only as intended for your personal learning. You may not copy, publish, transmit, distribute, modify, sell, or publicly display any of our content without our explicit written permission.
- Trademarks: “Al Balagh Quran Academy” and our logos are our trademarks. You may not use them without consent.
- Copyright Infringement: We respect copyright. If you believe any user content or other material on our site infringes your copyright, please contact us with details, and we will respond in accordance with applicable law.
Any unauthorized use of our intellectual property may result in legal action and termination of your account.
- Modification of Terms
We may revise these Terms at any time. When we do, the “Last Updated” date will change. We will post the new Terms on our site and may notify registered users by email. It is your responsibility to review the Terms periodically. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using our services.
- Jurisdiction and Applicable Law
These Terms are governed by the laws of India. Any dispute arising under or related to these Terms (including payment or refund issues) shall be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal, India.
However, nothing in these Terms is intended to exclude or limit your legal rights under local consumer protection laws in your country. For example, EU consumers have specific rights under EU Directive 2011/83/EU (e.g. the 14-day withdrawal period) and other regulations, which we will respect. Similarly, US consumers retain rights under federal and state law (including COPPA provisions for children). If any provision of these Terms is held invalid by a competent authority, the remaining provisions will remain in force.
